1. Preamble and Scope

These Terms and Conditions (hereinafter referred to as “T&Cs”) constitute a legally binding agreement between the User (hereinafter “You” or “User”) and theANSARI (hereinafter “Company”, “We”, or “Us”), governing your access to, and use of, the online platform available at www.theansari.shop and any related digital or physical service channels including but not limited to WhatsApp communications, direct orders, and offline sales (collectively, the “Platform”).

By engaging with the Platform, whether by browsing, transacting, or otherwise, the User unequivocally consents to be legally bound by these T&Cs, which shall be read in conjunction with the Privacy Policy, Return Policy, and any other applicable policies.

2. Eligibility and Capacity to Contract

Use of the Platform is strictly contingent upon the User being of legal age (i.e., 18 years or older) and possessing the requisite legal capacity to contract under applicable laws of India. Persons disqualified under the Indian Contract Act, 1872 are not eligible to use the Platform.

3. Nature of Products

All products offered on the Platform, including but not limited to Attars, Perfume Oils, Fragrance Blends, are:

• Non-alcoholic, traditional, and luxury-focused.

• For external use only, unless otherwise expressly indicated.

• Subject to olfactory subjectivity; no claims of medical efficacy or diagnostic properties are made or implied.

4. Order Placement and Contract Formation

Upon placement of an order, the same shall be deemed to constitute an invitation to offer, which may be accepted or rejected by the Company at its sole discretion. Acceptance shall be conveyed via electronic confirmation (email/WhatsApp/SMS), at which point a binding contract of sale shall be deemed to exist.

We reserve the right to refuse or cancel orders at our sole discretion, including but not limited to:

• Suspected fraudulent transactions

• Bulk purchases for resale without wholesale agreement

• Unserviceable delivery locations

5. Pricing and Payment

All prices are denominated in INR and inclusive of applicable GST unless stated otherwise. We reserve the right to revise prices without prior notice.

Accepted modes of payment include:

• UPI

• Credit/Debit Cards

• Net Banking

• Wallets (if enabled)

• Cash on Delivery (subject to location)

Payment gateways are third-party entities, and we disclaim liability for gateway-related failures or breaches.

6. Shipping, Delivery & Risk of Loss

Delivery timelines are indicative and not contractually binding. Risk of loss and title to the goods shall pass to the User upon dispatch from our warehouse or fulfillment center.

Delays caused due to Force Majeure events (natural calamities, civil unrest, pandemic lockdowns, courier strikes, etc.) shall not render the Company liable.

7. Returns, Refunds & Cancellations

Due to the personal nature of fragrance products, returns or refunds shall only be entertained in the following circumstances:

• Product leakage or tampering upon delivery

• Wrong item dispatched

Requests must be raised within 24 hours of delivery with appropriate visual evidence. We reserve the right to decline frivolous, incomplete, or abusive claims.

No returns/refunds will be accepted for reasons based on subjective dislike of scent.

8. Intellectual Property Rights

All trademarks, trade dress, branding elements, product photography, written descriptions, design templates, packaging, and scent formulations are proprietary to the Company.

Unauthorized reproduction, duplication, scraping, reverse engineering, or misrepresentation of our IP shall attract civil and criminal remedies under the Copyright Act, 1957 and Trademarks Act, 1999.

9. User Conduct & Restrictions

Users agree:

• Not to engage in abusive, defamatory, or unlawful behavior on any channel linked to the Platform.

• Not to copy, misrepresent, or commercially exploit the Platform or its contents.

• Not to bypass, disable, or otherwise interfere with security features of the Platform.

Violation of these conditions may result in account termination and legal action.

10. Limitation of Liability

To the fullest extent permitted under law, the Company, its officers, agents, suppliers, or affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from:

• Usage or misuse of any product

• Reliance on platform content

• Technical glitches or service interruptions

Our total aggregate liability shall not exceed the monetary value of the specific transaction giving rise to the claim.

11. Indemnification

You hereby agree to indemnify, defend, and hold harmless the Company and its officers, employees, agents, and affiliates from any and all losses, liabilities, claims, damages, costs, and expenses, including legal fees, arising out of:

• Your violation of these T&Cs

• Misuse or abuse of the Platform

• Violation of third-party rights, including intellectual property

12. Force Majeure

The Company shall not be held liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: acts of God, internet disruptions, governmental actions, courier strikes, or pandemics.

13. Governing Law and Jurisdiction

These T&Cs shall be governed by, construed, and enforced in accordance with the laws of India. Subject to arbitration, courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction in any dispute arising herefrom.

14. Dispute Resolution and Arbitration

Any dispute shall first be attempted to be resolved amicably. Failing such resolution within 30 days, the matter shall be referred to a sole arbitrator appointed mutually, and governed by the Arbitration and Conciliation Act, 1996, seated in Lucknow, in English language.

15. Modifications

We reserve the unilateral right to modify, amend, or update these T&Cs, at any time, without prior notice. Continued use of the Platform post any modifications shall constitute express consent to the revised terms.
